No one wants to go through the experience of having their home foreclosed. That is why you should take the time to find a good foreclosure attorney who will give you the proper legal advice and guidance so you can keep from having your home taken away. Keep in mind time and money as you are going through this process. A foreclosure attorney may or may not be the right choice for you if you consider those factors.
What Is Foreclosure?
When a homeowner does not pay their mortgage payments, or fails to pay their property taxes, a lender can put the house into foreclosure, which means that they can sell the property with or without notice to the borrower. Reasons for delinquency payments range from lay offs at work, divorce, or other unfortunate life events that occur which leave the borrower drowning in debt. Most people try to find alternate ways of financing their house before they allow it to be foreclosed on. Borrowing from friends or family may be a good option if you have reliable sources of peers that are willing to help you while you are in a place of financial hardship.
Ways To Get Help
If you have enough funds to hire a foreclosure attorney to help you save your home, consider how much time and money you will have to invest into an attorney. Do some research; ask around to find the right one for you. Once you have found a reputable foreclosure attorney, they will usually suggest options available to you. One option is filing for Chapter 13 bankruptcy, which will stop a foreclosure right away and will allow you up to three years to catch up on your mortgage payments.
An attorney will also suggest that you agree to a settlement with your lender, in which an arrangement can be made that will allow you to keep your home and catch up with your payments, or make lower ones. In most cases, if your foreclosure case is won, then most attorneys will incur up to 75% of their fees. If the case is not won, or is dismissed, then the foreclosure attorney will not charge you.
In the end, choosing to spend money on a foreclosure attorney is entirely up to you. If you feel that you cannot defend yourself properly, then hiring someone to do it for you may be the best option.
